Terms of Use

These Terms of Use govern your use of Sundaze, an application published by Bitward. By downloading, purchasing, or using Sundaze, you agree to these Terms. Your use of the application is also subject to Apple’s applicable terms and standard Licensed Application End User License Agreement.

About Sundaze

Sundaze presents current weather conditions and forecasts through an interactive visual experience. Weather information is provided by third-party services, including WeatherAPI.com, and delivered through infrastructure operated using Cloudflare.

Licence

Subject to these Terms and Apple’s applicable licence terms, Bitward grants you a limited, personal, non-exclusive, non-transferable and revocable licence to use Sundaze on Apple devices that you own or control.

You may not copy, sell, sublicense, rent, lease or commercially redistribute Sundaze; reverse engineer or attempt to extract its source code except where applicable law expressly permits it; interfere with the app or its infrastructure; or misuse private API keys or services used by the app.

Free tier and Sundaze Premium

Sundaze offers a permanent free tier: the complete visual experience, weather and the forecast for the current day at your current location, your first trading card, and photo export. Additional features — forecasts up to three days ahead, the full event and card collection, video export, the Home Screen widget, searching for the sky of any city in the world, and the in-app mini-games — are part of Sundaze Premium, an auto-renewable subscription available as a weekly or an annual plan. Both plans unlock the same features. Places already saved in the app remain available without a subscription.

Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically for successive periods of the same duration unless you cancel it at least 24 hours before the end of the current period. You can manage or cancel it at any time in your Apple Account’s subscription settings, or from within Sundaze, which opens Apple’s management screen. Prices are shown in the app for your App Store storefront and may vary by region; price changes for existing subscribers are handled and communicated according to Apple’s rules. Switching from the weekly to the annual plan takes effect immediately under Apple’s upgrade rules.

Purchases can be restored on a new or reset device with “Restore Purchases” inside the app. When a subscription ends or is refunded, Premium features lock again; discoveries recorded while the collection was locked are retained and are added to your collection under an active subscription.

Purchases, renewals and refunds are processed by Apple. Refund requests are made to Apple, for example at reportaproblem.apple.com. If you are a consumer in the European Union, any statutory right of withdrawal for digital content and services is exercised through Apple.

Purchases and refunds

Purchases are processed by Apple through the App Store. Apple manages payment processing, purchase history, redownloads, Family Sharing where available, and refund requests according to its policies. Bitward does not receive your complete payment-card information.

Weather information

Weather conditions, forecasts, alerts and related information are estimates based on third-party data and may be delayed, incomplete, inaccurate or different from conditions at your precise location.

Sundaze is intended for general informational and visual purposes. Do not rely on it as your sole source for personal safety, emergency response, aviation, marine navigation, professional transport, agriculture, industrial operations, or any activity where inaccurate weather information could cause injury, loss or damage. Consult official meteorological services and local authorities when safety is involved.

Location access

Sundaze may request access to your device location to retrieve weather information for your current position. Access is optional and controlled through Apple’s iOS permission system. You may deny or revoke it in your device settings, although some features may then be unavailable. See the Privacy Policy for details.

Third-party services

Sundaze relies on services operated independently by WeatherAPI.com, Apple (whose Apple Weather service supplies part of the weather data) and Cloudflare. These services may be governed by their own terms and privacy policies. Bitward does not control them and cannot guarantee their permanent availability, accuracy, security or continued compatibility.

Changes, updates and availability

Bitward may update, modify, suspend or discontinue features where reasonably necessary for security, technical, legal, platform, provider or product reasons. Sundaze may require updates to remain secure and compatible. You are responsible for maintaining a compatible device and installing available updates.

Bitward may remove Sundaze from sale. Existing installed copies may continue to function, but redownloads and continued operation can depend on Apple, third-party services and technical compatibility.

Intellectual property

Sundaze, including its source code, visual design, animations, branding, text and original assets, is owned by Bitward or its licensors and protected by applicable intellectual-property laws. Weather data and third-party names, trademarks and materials remain the property of their respective owners.

Acceptable use

You agree not to use Sundaze unlawfully, overload or disrupt its infrastructure, automate excessive requests, scrape weather information, introduce harmful code, impersonate others, or infringe the rights of Bitward or third parties.

Disclaimer

To the maximum extent permitted by law, Sundaze is supplied on an “as available” basis. Bitward does not guarantee uninterrupted availability, absolute accuracy or suitability of weather information for a particular purpose. Nothing in these Terms excludes guarantees or remedies that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Bitward will not be liable for indirect, incidental, special or consequential loss arising from use of, inability to use, or reliance on Sundaze or its weather information. This limitation does not apply where liability cannot lawfully be excluded or limited, including mandatory consumer protections.

Termination

You may stop using Sundaze at any time by deleting it. Bitward may restrict or terminate the licence if you materially breach these Terms, misuse the app or attempt to compromise its security or infrastructure.

Privacy

Your use of Sundaze is also governed by the Sundaze Privacy Policy.

Changes to these Terms

Bitward may update these Terms to reflect changes to Sundaze, its providers, laws or Apple’s requirements. The latest version will be published here with a revised effective date. Changes will not retroactively reduce mandatory rights related to a purchase already made.

Governing law

These Terms are governed by French law, without prejudice to mandatory consumer protections available under the laws of your country of residence. The parties will first attempt to resolve disputes amicably.

Severability

If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply.
